Sale Conditions

BID PRICE – Each buyer must have an assigned Buyer’s Number.  The highest bidder on a lot shall be the buyer of the lot.  The purchase price shall be the sum of (1) the price at which the animal(s) are sold, plus (2) ALL appropriate breed registry fees required to transfer ownership of the animal(s) purchased into buyer’s name.

REGULATION OF BID – The Auctioneer shall regulate the bidding and shall be the sole arbiter of any disputes.  University of Florida reserves the right to withdraw animal(s) at any time before the sale and/or to reject a bid from any bidder.

PHONE BIDDING – Registered bidders may participate in the live auction by phone.  The Department of Animal Sciences assumes no responsibility for failure to execute the phone bid form for any reason whatsoever.  NOTE THAT ALL PHONE BID REGISTRATIONS MUST BE RECEIVED BY NOON EASTERN TIME, APRIL 22nd IN ORDER TO PARTICIPATE.

ABSENTEE BIDDING – Registered bidders may place bids by “Absentee Bid Form”.  NOTE THAT ALL ABSENTEE BID FORMS MUST BE RECEIVED BY NOON EASTERN TIME, APRIL 22nd.  Bidder is solely responsible for providing accurate lot #, registered name of animal and maximum bid. Department of Animal Sciences assumes no responsibility for failure to execute these bids for any reason whatsoever.  In the event of a tie, the floor bid will prevail against the absentee bid. All bids will be treated as offers subject to the Conditions of Sale.

PAYMENT AND PICK UP – The balance of the invoice(s) must be paid in full and animal(s) picked up by 6:00 PM on sale date unless prior arrangements have been made with the University of Florida Horse Teaching Unit.  A Board Fee of $12.00/day will apply to animal(s) not picked up on April 23rd, 2016.

PAYMENT – Cash, Cashier’s Check, Personal Check, Visa, Mastercard, American Express, and Discover are accepted.  2% will be added to the sale price of each animal purchased by credit card. All Animal Registration Papers and Transfers are held until all payments have cleared.  At which time, University of Florida Department of Animal Sciences will process animal registration transfers with appropriate breed registry.  Bidders paying by cash, cashier’s check, or credit card will have registration papers processed and mailed to appropriate breed registry on the first available business day.

OWNERSHIP TRANSFERAccurate Breed Membership information required to complete ownership transfer.  University of Florida holds all ownership paperwork until payments have cleared and will mail completed transfers on owner’s behalf.  Cost of ownership transfer is the responsibility of the buyer and will be added to the sale price of each animal purchased according to the fee schedule of the appropriate breed registry.

GOVERNING LAW – The University of Florida, Department of Animal Sciences is a Florida based non-profit educational organization.  All horses in this sale are offered according to the laws of the State of Florida and all transactions between the buyer and seller will be governed by those laws.

Title Risk and DeliveryTitle passes to purchaser at the fall of the hammer.  At which time buyer assumes all risk and responsibility for the horse(s) located at the UF/IFAS Horse Teaching Unit, 1934 SW 63rd Ave, Gainesville, FL  32608.

Warranties There is no warranty, express or implied by University of Florida, Department of Animal Sciences as to the soundness, condition, merchantability, or fitness for any particular purpose of any horse offered in this sale.  Except for any limited warranties made in writing and dually signed by an authorized Department of Animal Science representative, each animal is sold “AS IS”.  It is responsibility of the buyer to research all known and unknown medical histories and request pre-purchase exams and diagnostics at his/her expense.
